IF YOU DON’T HAVE A PLAN, THE GOVERNMENT DOES!

You may ask, but why NOW? Why not wait until I retire? Many retirees wisely set up family trusts. However, more and more young people are setting up trusts because they recognize that a trust can help protect them against an uncertain future should they become incapacitated or pass away suddenly.

If you don’t have a Family Trust or Revocable Living Trust, your family is left with the Government’s Plan, instead of yours. The Government’s Plan is fairly straightforward, based on a set of criteria and a formula for the distribution of your assets. If you would like to read the complete criteria,

In a nutshell, all of your assets are liquidated and distributed in cash. Without a Trust, you cannot place any restrictions on when or under what circumstances a child or grandchild can receive property. Under your plan heirs might have criteria placed on them based on a higher age of maturity, or they may be required to first graduate from college. Consider this. Would you want an 18 year old driving around in a new sports car, because he or she blew their entire inheritance while driving past a car dealership?

President, William F. Cunningham, Jr. is a Nationally Certified Paralegal, Legal Document Assistant, and Notary Public with over 30 years experience in the legal services field. Prior to this career, he served in the United States Coast Guard and was part of the permanent crew aboard the tall ship, the USCG Barque Eagle.

Bill has served as a volunteer for the Santa Ana Police Department’s Division for Homeland Security and was instrumental in establishing the Santa Ana Police Foundation. He is now the Executive Director of the Police Foundation which shares offices with Eagle Planning Group in the city of Santa Ana. For more information about the Police Foundation, click here.

Bill’s wife, Holly, serves as a Legal Document Assistant for Eagle Planning Group. She has also spent the last 30 years in public service, including the last 13 years as a high school English teacher.
